1. Acceptance of Terms

By accessing or using the Mystical Realms website and web application located at https://mystical-realms.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("you" or "User") and Joshua McLain, operating as Mystical Realms ("we," "us," or "our").

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and notify registered users via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you disagree with any changes, you must stop using the Service and delete your account.

2. Eligibility

The Service is intended for individuals aged 18 years or older. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

If we learn that a person under 18 has created an account or provided personal information, we will promptly delete the account and all associated data.

3. Description of the Service

Mystical Realms is a web application that provides tarot card readings, astrology chart generation, personal journaling, and related self-reflection tools. The Service includes, but is not limited to:

• Tarot readings — interactive card draws with optional AI-generated interpretations
• Card of the Day — a daily single-card draw
• Natal chart generation — astrological birth chart calculations using Swiss Ephemeris
• Synastry comparison — relationship chart analysis comparing two birth charts
• Transit charts — current planetary position tracking
• Astrological dice — randomized planet, sign, and house rolls with optional AI interpretation
• Personal journal — freeform journaling with tags, mood tracking, and export capabilities
• Custom tarot spreads — a visual editor for creating, sharing, and forking tarot spread layouts
• Community features — browsing and forking publicly shared tarot spreads
• Educational content — static reference pages about tarot and astrology history, symbolism, and techniques
• PDF export — downloadable chart reports with optional AI interpretation

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscription tiers in the future, at which point separate billing terms will be provided.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (Google or Apple). You agree to:

• Provide accurate, current, and complete information during registration
• Keep your login credentials secure and confidential
• Notify us immediately at legal@mystical-realms.com if you suspect unauthorized access to your account
• Not share your account with or transfer it to any other person

4.2 Account Responsibility

You are solely responsible for all activity that occurs under your account, whether or not you authorized that activity. We are not liable for any loss or damage arising from unauthorized use of your account.

4.3 Account Deletion

You may delete your account at any time through the account settings. Upon deletion, all of your data — including profile information, readings, journal entries, charts, spreads, birth profiles, and preferences — will be permanently and irreversibly deleted from our systems. This action cannot be undone.

5. Entertainment and Self-Reflection Disclaimer

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

5.1 For Entertainment and Self-Reflection Only

The Service, including all tarot readings, astrology chart calculations, AI-generated interpretations, synastry analyses, transit reports, dice rolls, and all other content generated by or through the Service, is provided solely for entertainment, educational, and personal self-reflection purposes.

5.2 Not Professional Advice

Nothing provided through the Service constitutes, nor should it be construed as:

• Medical or health advice — The Service is not a substitute for professional medical diagnosis, treatment, or counseling. If you are experiencing a medical or mental health emergency, contact a qualified healthcare provider or call emergency services immediately.
• Psychological or therapeutic advice — The Service is not a substitute for licensed therapy, counseling, or psychological treatment.
• Financial or investment advice — Do not make financial decisions based on tarot readings or astrological interpretations.
• Legal advice — The Service does not provide legal guidance of any kind.
• Relationship counseling — Synastry charts and relationship-focused content are not substitutes for professional relationship counseling or therapy.

5.3 AI-Generated Content

AI-powered interpretations are generated by Google Gemini, a third-party large language model. You understand and agree that:

• AI-generated content may be inaccurate, incomplete, inconsistent, or misleading
• AI outputs do not represent the views, opinions, or endorsements of Mystical Realms
• AI outputs have no special metaphysical, spiritual, or divinatory authority
• You should not make important life decisions based on AI-generated interpretations
• AI service availability may be intermittent due to third-party rate limits or outages

5.4 Astrological and Tarot Calculations

Astrological calculations are performed using the Swiss Ephemeris, a scientifically accurate astronomical calculation library. While the astronomical positions are mathematically precise, the interpretive frameworks (astrology, tarot) applied to those positions are belief systems and cultural traditions, not empirically validated sciences. We make no claims about the predictive accuracy or spiritual validity of any astrological or tarot content.

5.5 No Guarantees

We do not guarantee that the Service will provide any specific outcome, insight, benefit, or result. Use of the Service is entirely at your own discretion and risk.

6. User-Generated Content

6.1 Types of User Content

"User Content" means any content you create, upload, or submit through the Service, including but not limited to:

• Custom tarot spread layouts (titles, descriptions, position labels, notes)
• Journal entries
• Questions submitted for tarot readings or astrological dice rolls
• Birth data entered for chart calculations

6.2 Ownership

You retain ownership of your User Content. We do not claim ownership of any content you create through the Service.

6.3 License Grant for Public Content

When you make a tarot spread public using the visibility toggle, you grant Mystical Realms and other users of the Service a non-exclusive, worldwide, royalty-free license to display, reproduce, and create derivative works of that spread (including via the "fork" feature) for the purpose of operating and providing the Service. This license continues for as long as the spread remains public. You may revoke this license by making the spread private or deleting it, except with respect to copies already forked by other users.

6.4 License Grant for Private Content

For private content (journal entries, private spreads, readings), we retain only the limited technical license necessary to store, process, display, and transmit that content back to you as part of operating the Service.

6.5 Responsibility for User Content

You are solely responsible for your User Content. By submitting content, you represent and warrant that:

• You have the right to submit the content and grant the licenses described above
• The content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights
• The content complies with Section 7 (Acceptable Use Policy) of these Terms

7. Acceptable Use Policy

You agree not to use the Service to:

7.1 Prohibited Conduct

• Violate any applicable local, state, national, or international law or regulation
• Harass, abuse, threaten, defame, or intimidate any person
• Submit content that is hateful, discriminatory, obscene, pornographic, or promotes violence
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity
• Submit content that infringes any intellectual property right, trademark, trade secret, or other proprietary right of any third party
• Attempt to gain unauthorized access to the Service, other users' accounts, or any systems or networks connected to the Service
• Use the Service for any commercial purpose without our prior written consent, including reselling access, scraping data, or republishing content at scale
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit malware, viruses, or any malicious code
• Use automated tools (bots, scrapers, crawlers) to access or interact with the Service without our express permission
• Engage in any activity that could damage, disable, overburden, or impair the Service

7.2 Community Spread Guidelines

When creating public spreads, you agree that spread titles, descriptions, and position labels must:

• Not contain hate speech, slurs, or discriminatory language
• Not contain sexually explicit or pornographic content
• Not promote illegal activities
• Not contain personal information of third parties without their consent
• Not impersonate official Mystical Realms content

7.3 Reporting and Enforcement

Users may report public spreads that violate these guidelines. We reserve the right, but have no obligation, to:

• Review reported content
• Remove or disable access to any content that violates these Terms
• Suspend or terminate accounts that violate these Terms, with or without notice
• Cooperate with law enforcement authorities if required by law

We are not obligated to monitor or actively moderate User Content, but we may do so at our sole discretion.

8. Third-Person Data (Synastry and Multi-Person Features)

The synastry feature allows you to enter birth data (date, time, and place of birth) for another individual. By using this feature, you represent and warrant that:

• You have obtained the other person's informed consent to submit their birth data to the Service, or you have another lawful basis to do so
• You are responsible for informing the other person about how their data will be processed, as described in our Privacy Policy
• You will indemnify and hold us harmless from any claims arising from your submission of another person's data without their consent

We have no direct relationship with individuals whose birth data you submit. If such a person contacts us requesting access to, correction of, or deletion of their data, we will notify you and work to honor their request.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, user interface, software code, features, branding, logos, and the "Mystical Realms" name and mark, are owned by or licensed to Joshua McLain and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service or any part of it, except as expressly permitted by these Terms.

9.2 Tarot Card Content

The Service includes tarot card data (names, keywords, meanings) and imagery derived from the Rider-Waite-Smith tarot deck (originally published in 1909), which is in the public domain. Alternate deck art (e.g., neon, artistic skins) are proprietary to Mystical Realms and may not be copied, distributed, or used outside of the Service.

9.3 Educational Content

The Learn Tarot and Learn Astrology educational pages contain original written content that is copyrighted by Mystical Realms. You may not reproduce, republish, or redistribute this content without our prior written consent.

9.4 Open-Source Components

Portions of the Service use open-source software, including but not limited to Swiss Ephemeris (pyswisseph). Such components are subject to their respective open-source licenses, which are not superseded by these Terms.

10. DMCA and Copyright Complaints

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, to our designated agent:

Your notice must include:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material that is claimed to be infringing, and information sufficient to locate it on the Service
4. Your contact information (address, telephone number, and email)
5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing material and, where appropriate, terminating accounts of repeat infringers.

Counter-Notice: If you believe your content was removed in error, you may submit a counter-notice to the DMCA Agent with the information required by 17 U.S.C. § 512(g).

11. Privacy

Your use of the Service is also governed by our Privacy Policy and our Cookie Policy, which describe how we collect, use, store, and protect your personal information, including our use of cookies and similar storage technologies. By using the Service, you consent to the practices described in the Privacy Policy and Cookie Policy.

12. Third-Party Services

The Service integrates with the following third-party services. Your use of the Service may be subject to the terms and policies of these providers:

We are not responsible for the practices, content, or availability of these third-party services. If any third-party service becomes unavailable, certain features of the Service (such as AI interpretations or location search) may be degraded or unavailable.

13. Disclaimers and Limitation of Liability

13.1 "As Is" and "As Available"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING AI-GENERATED INTERPRETATIONS, ASTROLOGICAL CALCULATIONS, OR TAROT READINGS

13.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JOSHUA McLAIN, MYSTICAL REALMS, OR ANY OF ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY DAMAGES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE
• ANY DAMAGES RESULTING FROM ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI-GENERATED CONTENT
• ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

13.3 Assumption of Risk

You acknowledge that tarot readings, astrological interpretations, and AI-generated content are inherently subjective and unverifiable. You assume all risk associated with your use of and reliance on such content.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Joshua McLain, Mystical Realms, and its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your submission of another person's birth data without their consent
• Your violation of any applicable law or third-party right

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") informally by contacting us at legal@mystical-realms.com with a written description of the Dispute, relevant facts, and the relief you seek. We will attempt to resolve the Dispute within thirty (30) days of receiving your notice.

15.2 Binding Arbitration

If the Dispute is not resolved within 30 days of the informal resolution attempt, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English, in Maricopa County, Arizona, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND MYSTICAL REALMS AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

15.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims eligible for small claims court in Maricopa County, Arizona may also be brought there instead of arbitration.

15.5 Opt-Out Right

You may opt out of the arbitration and class action waiver provisions within 30 days of first accepting these Terms by sending a written notice to legal@mystical-realms.com with the subject line "Arbitration Opt-Out" including your name, email address associated with your account, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.

16. Governing Law

These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law principles. To the extent that litigation is permitted under these Terms, you consent to the personal jurisdiction of the state and federal courts located in Maricopa County, Arizona.

17. Termination

17.1 Termination by You

You may terminate your account at any time by deleting your account through the Service's account settings. Upon termination, all your data will be permanently deleted as described in Section 4.3.

17.2 Termination by Us

We reserve the right to suspend or terminate your account, or restrict your access to all or part of the Service, at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms, including the Acceptable Use Policy
• Conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties
• Extended periods of inactivity (with reasonable prior notice)
• Legal or regulatory requirements

17.3 Effect of Termination

Upon termination:

• Your right to access and use the Service ceases immediately
• We may delete all data associated with your account
• Sections 5 (Disclaimer), 6.3 (License Grant for Public Content as to previously forked copies), 9 (Intellectual Property), 13 (Disclaimers and Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), 16 (Governing Law), and 18 (General Provisions) survive termination

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Mystical Realms regarding your use of the Service and supersede all prior agreements, understandings, and communications.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver of any right or provision will only be effective if made in writing and signed by us.

18.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, third-party service failures, or pandemics.

18.6 Notices

We may provide notices to you via email at the address associated with your account, or by posting notices within the Service. You may send notices to us at legal@mystical-realms.com.

18.7 No Third-Party Beneficiaries

These Terms do not confer any rights or remedies upon any person or entity other than you and Mystical Realms.

18.8 Headings

Section headings are for convenience only and have no legal or contractual effect.
